MINUTE ORDER SETTING HEARING AND RESETTING PRETRIAL CONFERENCE: The parties' counsel shall appear in person on Jan 24, 2013, at 9:30 a.m. to participate in (1) the Pretrial conference; (2) a Daubert hearing on the admissibility of the expert opinions of Dr. Wu (Plaintiff's expert) and Dr. Bozarth (Defendant's expert); and (3) argument on the Defendant's Motion to Quash the Subpoena to Ronald Stokes issued by the Southern District of New York. The Parties should be prepared to address the effectiveness of subpoena and the discoverability of the allegedly privileged documents it seeks. The Court will order that the medical records in Defendant's possession be produced to the Plaintiff, and that issue need not be addressed. The Pretrial Conference scheduled for January 17 is stricken. s/Jean Boring as directed by Judge Ronald B. Leighton.
