Pretrial Conference - Initial ~Util - Set Deadlines/Hearings
Minute Order for proceedings held before Magistrate Judge James M. Wicks: CIVIL CAUSE FOR FINAL PRETRIAL CONFERENCE. Counsel for Plaintiff: Steven G. Leventhal. Counsel for Defendant: Brian S. Sokoloff, Connor Mulry. Final Pretrial Conference held on 1/25/2024 at 12:30 PM. The Court reviewed with counsel for the parties the proposed joint pretrial order. Following which there was discussion concerning legal issues that could possibly be resolved through summary judgment practice. Accordingly, the Court entered a briefing schedule for Defendant's motion for summary judgment as follows: (i) Defendant's Motion served by March 29, 2024; (ii) Plaintiff's Opposition served by May 31, 2024; and (iii) Defendant's Reply served by June 14, 2024. The parties are to provide hard copies of their respective motion papers to Chambers on the respective dates of service. Counsel are reminded to review their respective Rule 56.1 statements and responses to ensure the paragraphs are correctly numbered and correlate with each other. Approval of the JPTO will be held in abeyance pending resolution of the anticipated motion for summary judgment. Counsel for Defendant is directed to comply with the undersigned's Individual Practice Rules with respect to bundle filing the fully briefed motion on or before June 14, 2024. See Rule 3.C.1.A. An in-person Oral Argument on the Motion is scheduled for July 25, 2024 at 10:00 AM at the United States District Courthouse, Eastern District of New York, 100 Federal Plaza, Courtroom 1020, Central Islip, New York.
