Minute Order Order on Discovery Plan and Scheduling Order
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Nancy J. Koppe on 9/4/2026. Pending before the Court is a joint discovery plan seeking a discovery period that is more than double the presumptively reasonable amount of time. Docket No. 28 ; Local Rule 26-1(b)(1). In seeking this extraordinary relief, the parties reference the pendency of a motion to dismiss and that parallel discovery is happening in state court. Docket No. 28 at 1. The former is not sufficient justification to double the presumptively reasonable discovery period. See Tradebay, LLC v. eBay, Inc., 278 F.R.D. 597, 601 (D. Nev. 2011). As to the latter, the discovery plan provides no elaboration, including the case management schedule entered in the state court proceeding. Accordingly, the discovery plan is DENIED without prejudice. An amended discovery plan must be filed by September 9, 2026. IT IS SO ORDERED. (Copies have been distributed pursuant to the NEF - TM)
