ORDER RE ESI PROTOCOL: As discussed at the conference held via Microsoft Teams on August 27, 2026, the Court has revised the ESI Protocol. Attached are two documents. One is a redline comparison between (i) the protocol adopted by the Court on July 6, 2026 (Dkt. 442) and reflected in Defendants' submission on July 17, 2026 at Dkt. 446-1, and (ii) that same protocol revised based on the Court's discussion with the parties at the conferences held on August 24 and August 27, 2026, and the Court's rulings during those Conferences. The other document is a clean version of the revised protocol. As foretold at the August 27 conference, before finalizing the revised protocol, the Court is providing the parties with an opportunity to review the revised protocol and suggest any necessary corrections. This opportunity is not an opportunity to reargue the issues raised on Plaintiffs' motions for reconsideration, and the parties shall refrain from doing so. Any suggested corrections shall be made by letter filed by September 2, 2026. After reviewing any such suggestions, the Court will issue the final ESI Protocol. SO ORDERED. ORDER ON MOTIONS FOR RECONSIDERATION OF ESI PROTOCOL (DKTS. 448, 452) granting in part and denying in part 448 Motion for Reconsideration; granting in part and denying in part 452 Motion for Reconsideration. For the reasons set forth above, and those set forth during the Conferences, Plaintiffs' motions for reconsideration are GRANTED IN PART and DENIED IN PART as will be reflected in a revised ESI protocol. To the extent not discussed above, or during the Conferences, the Court ha s considered Plaintiffs' other arguments and finds them to be without merit.
