ORDER. Plaintiff's request for "clarification and [the] prospective enforcement of" the parties' protective order, Dkt. No. 128, is denied. The protective order speaks for itself; the plaintiff does not presently assert any violations; and the plaintiff's motion for "clarification" was not authorized by the Federal Rules of Civil Procedure or the District's Local Rules. The Court did not set a pretrial conference for September 17, 2026, and so Home Depot's "emergency administrative motion to change time of pre-trial conference" filed on September 16, 2026, Dkt. No. 158, is terminated as moot. The Court is not able to accommodate a trial on October 6, 2026. Consequently, the trial is continued to February 1, 2027, at 9:00 a.m., and a pretrial conference is set for January 7, 2027, at 1:30 p.m. The fact discovery cut-off is set for October 16, 2026, and plaintiff's "emergency motion for expedited discovery relief and protective order," Dkt. No. 127, is terminated as moot. The parties have filed numerous "emergency" motions and other motions that are not authorized by the rules of procedure. The parties have submitted their pretrial filings and all that is left in this case is trial. Pending the trial date, no further motions will be accepted unless expressly authorized in advance by the Court. The case will be administratively closed pending the pretrial conference. Signed by Judge James Donato on 9/17/2026. (This is a text-only entry generated by the court. There is no document associated with this entry.) (jdlc2, COURT STAFF) (Filed on 9/17/2026)
