DECISION AND ORDER. For the reasons discussed in the attached Decision and Order, the Court accepts and adopts Judge Schroeder's recommended disposition as to the parties' cross motions for summary judgment and thereby DENIES Plaintiff's and Defendant's motions for summary judgment [ECF No. 50] [ECF No. 49] as to the gender discrimination claim and the retaliation claim, but holds that Defendant did not engage in spoliation and thereby DENIES Plaintiff's request for sanctions [ECF No. 50].
The parties are directed to confer and contact Judge Vacca's chambers at vacca@nywd.uscourts.gov to schedule a pre-trial conference.
