Pretrial Conference - Initial
Minute Entry for proceedings held before Judge Nina R. Morrison:
An initial pre-trial conference was held before Judge Morrison on May 22, 2024. Andrew Weiss appeared on behalf of Plaintiff. Shamsey Oloko appeared on behalf of Defendant. The Court reviewed the parties joint pretrial order. For the reasons stated on the record and without objection, the Court granted Plaintiff's and Defendants motions in limine to permit leading questions at trial of the adverse witnesses identified at the hearing. The Court also granted Plaintiff's motion to strike Defendants designations of Plaintiff's deposition testimony for the reasons stated on the record.
By June 6, 2024, Defendant shall file a motion for summary judgment setting forth the grounds for its contention that Plaintiff is not a healthcare worker under N.Y.L.L § 741, or, in the alternative, shall inform the Court that it withdraws this defense; if the motion is filed, Plaintiff shall file her opposition by June 20, 2024. If the parties cannot resolve the objections to Defendant's exhibits 2-8 and 14, Defendant shall file a written proffer on or before June 6, 2024, as to the purpose and relevancy of each exhibit it seeks to offer and shall explain why each exhibit is not cumulative of other evidence to be presented at trial and why the probative value of each exhibit is not outweighed by the risk of unfair prejudice under Fed. R. Evid. 403; Plaintiff shall file her opposition by June 20, 2024. Jury selection and jury trial shall begin on July 29, 2024 at 9:30 AM in Courtroom 6E North of the Brooklyn Courthouse.
The parties shall inform the Court if they would like a referral for a settlement conference and/or a referral to mediation through the Court's Trial Ready Rapid Mediation Program. (Court Reporter Stacy Mace.) (RS) -
