Nos. 96, 108) is DENIED; and the Court further ORDERS that Plaintiffs are permitted to depose Mr. Strader, no later than ten days prior to the commencement of trial, at Defendant's expense; and the Court further ORDERS that Plaintiffs' motion to compel Mr. Toner to testify, or in the alternative, to have the Court provide a missing witness instruction to the jury is DENIED with leave to renew; and the Court further ORDERS that the parties file a letter no later than Friday, October 16, 2026, advising of their position as to whether Plaintiff Julia Colwell should be terminated from this action because of the dismissal of the loss of consortium claim; and the Court further ORDERS that the Clerk of the Court serve a copy of this Order upon the parties in accordance with the Local Rules.
