MINUTES (IN CHAMBERS) ORDER RE DEFENDANTS' MOTION TO DISMISS OR STAY ACTION 19 by Judge Wesley L. Hsu. For the foregoing reasons, Defendants' Motion to Stay is DENIED, and Defendants' Motion in the Alternative to Dismiss is GRANTED. All claims against the City and de Len are hereby DISMISSED without prejudice and with leave to amend. If ALP chooses to file an amended complaint, it may do so within twenty-one (21) days of this Order. In the absence of amendment, judgment will be entered in favor of the Defendants. The Court also finds that de Len's denial of the subsidies is a legislative act, and therefore de Len is entitled to absolute immunity as to that conduct. That specific theory of liability is DISMISSED with prejudice. Defendants fail to meet their burden that de Len's conduct after the parties entered into the ENA, i.e., terminating the contract, was entitled to absolute immunity, however. (lom)
