This case has been referred to Magistrate Judge Bass Ehler for discovery supervision, including the authority to set, adjust, and extend all deadlines, and to conduct a settlement conference, if requested by the parties. As set forth in docket entry 38 , Plaintiff's amended complaint is due by 8/18/26, and Defendants' answer and/or responsive pleading is due by 9/15/26. On or before 9/29/26, the parties shall file an initial joint status report that includes the following information: (1) a description of the claims and defenses raised by the pleadings, including the basis for federal jurisdiction; (2) state the relief sought by Plaintiff; (3) a date by which the parties will make their Rule 26(a)(1) initial disclosures not more than 21 days from the date of Defendants' answer; (4) a date by which the parties will serve written discovery not more than 14 days after Rule 26(a)(1) initial disclosures are made; (5) a proposed deadline to join parties and amend the pleadings; (6) a proposed fact discovery close date; (7) whether any party anticipates the need for expert discovery; (8) whether the parties are interested in scheduling a settlement conference with the Court; (9) if settlement is premature, what must happen before such discussions occur and can be productive; and (10) anything else about the status of the case or anticipated discovery that the parties believe the Court should know. MINUTE entry before the Honorable April M. Perry: Oral ruling held 7/28/2026 on Defendants' partial motion to dismiss 22 . For the reasons stated in open court, the motion is denied as to Count IV, and granted as to Count V. Plaintiff is permitted to file an amended complaint by 8/18/2026 correcting the pleading issues with respect to Count V. Defendants are to answer or otherwise plead by 9/15/2026. If Defendants choose to file another partial motion to dismiss, the Court expects that they will also file an answer as to the unchallenged counts. As there are at least four counts that will be allowed to proceed, this case is referred to the Magistrate Judge for discovery supervision, including the authority to set, adjust, and extend all deadlines, and to conduct a settlement conference if requested by the parties.
