Status Conference
TEXT MINUTE ENTRY A status conference was held on July 8, 2026, before Magistrate Judge Ryan C. Carson. Jessica Hernandez appeared for Plaintiffs. Mike Hannon appeared for Defendants IHC Scott, Inc. and W.W. Clyde & Co. Alexandra Thrailkill appeared for Defendant Contractor Services, Inc. Nathan Heimes appeared for Defendants Rooster Zamora Jr. Trucking, LLC and Fernando Zamora Canchola. Alice Craig and Andrew Falcone appeared for Defendant Aldo Hernandez-Meza. No appearance for Defendant Barca Limited, LLC.
The parties discussed case progression and interest in mediation. Depositions are in progress. Plaintiffs anticipate taking a 30(b)(6) deposition of IHC Scott, Inc., and one additional deposition of an IHC Scott employee. It is anticipated that the parties will depose one employee from the Nebraska Department of Transportation. Plaintiffs' request for a two-week extension of the expert disclosure deadline from July 10 to July 24, 2026, was unopposed and is granted. All other deadlines set in the Third Amended Final Progression Order (Filing No. 116 ) remain in place.
The court did not order mediation at this time, but encouraged the parties to discuss settlement. If the parties agree that a court-supervised settlement conference may be beneficial, they are to contact chambers to schedule. At least one party anticipates filing a dispositive motion. The case is set for trial setting call on November 12, 2026, at 11:00 a.m. before Magistrate Judge Ryan C. Carson. Counsel shall use the conference instructions assigned to this case to participate in the call. 53 . Potential trial dates will be circulated prior to the call.
