Diversity jurisdiction requires an amount in controversy that exceeds $75,000, AND diversity of citizenship. (28 U.S.C. § 1332(a)(1)) ("(a)The district courts shall have original jurisdiction of all civil actions where the matter in controversy exceeds the sum or value of $75,000, exclusive of interest and costs, and is between(1)citizens of different States....") MINUTE entry before the Honorable Mary M. Rowland: Plaintiff's motion to remand 8 is granted. The Court agrees with Plaintiff that there is no federal question jurisdiction. This is an eviction action based in Illinois state law. Defendants have not met their burden to establish diversity jurisdiction. Tylka v. Gerber Prods. Co., 211 F.3d 445, 448 (7th Cir. 2000) (the removing party "bears the burden of demonstrating that the complete diversity and amount in controversy requirements were met at the time of removal."). Despite being directed by this Court to do so 6 , Defendants have failed to file any jurisdictional supplement demonstrating that complete diversity exists. And based on the allegations in the operative complaint 1 , the Court finds that complete diversity cannot be established, as all parties appear to be Illinois citizens. It may be that Defendants intend to raise federal defenses to the eviction action. But asserting "[f]ederal defenses to a well-pleaded complaint do not provide a basis for removal [to federal court]." Northeastern Rural Electric Membership Corporation v. Wabash Valley Power Association, Inc., 707 F. 3d 883, 890 (7th Cir. 2013) (citations omitted). The Court does not see any other basis for it to retain jurisdiction over this matter. The Clerk is therefore directed to remand this case forthwith to the Circuit Court of Cook County, Illinois. Civil case terminated. Mailed notice. (jg, ) (Entered: 12/12/2025)
