Order Dismissing/Closing Case or Party
PAPERLESS ORDER. THIS CAUSE came before the Court upon a sua sponte examination of the record. On June 30, 2026, the Court entered a Paperless Pretrial Order (ECF No. 5), requiring the Parties to file a joint scheduling report within ten (10) days of their joint scheduling conference, which was to be held "no later than twenty (20) days after the filing of the first responsive pleading by the last responding defendant, or within sixty (60) days after the filing of the complaint, whichever occurs first." See (ECF No. 5). The Order cautioned, "[f]ailure of counsel to file a joint scheduling report within the deadlines set forth above may result in dismissal, default, and the imposition of other sanctions including attorney's fees and costs." Id. That deadline has now passed, and no extension of time has been requested. Accordingly, based on the foregoing, it is ORDERED AND ADJUDGED that this action is DISMISSED WITHOUT PREJUDICE. The Clerk of Court is instructed to CLOSE this case. All pending motions, if any, are DENIED AS MOOT. The Parties may move to reopen this matter upon the filing of a joint scheduling report within thirty (30) days of the date of this Order. Any motion to reopen filed after this deadline must demonstrate good cause for the delay. If any Party fails to participate in preparing the joint scheduling report, the moving Party may file a unilateral scheduling report detailing its conferral efforts, and the Court may consider appropriate sanctions against the non-participating Party under Federal Rule of Civil Procedure 16(f) and 37(f) and Local Rule 16.1.I. Signed by Judge K. Michael Moore on 9/30/2026. (srn)
