Order on Motion to Clarify
ORDER re 542 Plaintiff's Motion for Clarification of Paragraph one of the Court's Minute Entry Dated April 29, 2024, Doc. No. 539. On March 11, 2024, upon the Parties' filings at Docket No. 512 and Docket No. 513 , the Court granted 480 Motion to Dismiss Claims Against Migo p/d/b/a Radar_Apps and Reservation of Rights as unopposed. Thereby, all claims as to Migo IQ, Inc. p/d/b/a/ Radar_Apps, Inc. were dismissed with prejudice. See Docket No. 514. On April 23, 2024, Co-Defendants Jonathan Kotthoff and Carol Leese filed 526 Mr. Jonathan Kotthoff and Mr. Carol Leese Migo, IQ, Inc.'s officers-Settlement Memorandum in Compliance with Court Order, alleging that claims against them should be dismissed considering the dismissal of claims against Migo IQ, Inc. In addition, and upon those same arguments, during the Settlement Conference held on April 29, 2024, Co-Defendants Carol Leese and Jonathon Kotthoff requested leave to file a motion to dismiss and supporting memorandum. In light of the Court's recent ruling at Docket No. 514, and this new request, the Court ordered the Parties to brief the matter. Considering the Parties remaining in this case, and the applicable case law, the Plaintiffs shall brief the Court as to whether they desire to continue to advance and argue claims against the aforementioned Co-Defendants.
