Order on Motion to Stay
ORDER denying: 80 "Motion to Stay." On December 18, 2025, the Court entered judgment in favor of Plaintiff after Defendant failed to oppose Plaintiff's Motion for Summary Judgment. (ECF No. 56 ); (ECF No. 57 ). Defendant moved to vacate that judgment on April 23, 2026, yet failed to identify any manifest error of law, newly discovered evidence, or otherwise valid grounds for the alteration of the judgment. (ECF No. 66 ). The Court therefore denied the motion. (ECF No. 67 ). Several months later, on July 6, 2026, Plaintiff moved for execution of judgment. (ECF No. 74 ). The Court ordered Defendant to respond to the motion no later than July 20, 2026. (ECF No. 75 ). At the eleventh hour, on July 20, Defendant moved for an extension of time, which the Court granted, providing Defendant until August 10 to respond to 74 "Motion for Execution of Judgment." Despite that additional time, Defendant never responded to the motion. On August 11, 2026, the Court granted 74 "Motion for Execution of Judgment." (ECF No. 79 ). Defendant thereafter filed the instant 80 "Motion to Stay," which requests that the Court stay the execution of judgment without requiring Defendant to post any additional bond or, in the alternative, with only a reduced bond. (ECF No. 80 at 2-3). Defendant does not contend that the automatic stay provision of Rule 62 is applicable in this case. See Fed. R. Civ. P. 62(c)(1) (holding that a "final judgment in an action for an injunction or receivership" is "not stayed after being entered."). Moreover, Defendant fails to proffer a sufficient "bond or other security" to justify the application of Rule 62(b). Accordingly, the instant 80 "Motion to Stay" is DENIED.
