PAPERLESS ORDER TO SHOW CAUSE AND FOR STATUS REPORT. THIS MATTER is before the Court sua sponte. On August 20, 2026, the Court issued an Order granting Plaintiffs' former attorneys' Motion for Leave to Withdraw as Counsel (DE 48 ) and requiring that, "[o]n or before September 9, 2026, Plaintiffs shall obtain substitute counsel or file written notice on the docket that they intend to proceed with the case on a pro se basis." (DE 51) (emphasis in original). On August 21, 2026, Plaintiffs' former attorneys filed a Notice of Compliance, stating they "sent a hard copy of the Order to Plaintiffs/Counter-Defendants Kyle Butler Rashley and Nicholas Dungey...." (DE 52 ). To date, Plaintiffs have not filed any entry on the docket, nor otherwise indicated whether they have obtained counsel or intend to proceed with the case on a pro se basis.
Accordingly, it is ORDERED AND ADJUDGED that on or before October 9, 2026, Plaintiffs shall SHOW CAUSE why sanctions should not be imposed for failure to comply with a Court Order, including entry of a default against them.
Additionally, on or before October 5, 2026, Defendant shall file a status report indicating what aspects of the discovery process remain outstanding.
