MINUTE entry before the Honorable Franklin U. Valderrama: Federal courts "have an independent obligation to determine whether subject-matter jurisdiction exists, even in the absence of a challenge from any party." Word Seed Church v. Vill. of Hazel Crest, 111 F.4th 814, 819 (7th Cir. 2024) (citation omitted). Plaintiff alleges diversity of citizenship in its complaint 1 . Plaintiff properly alleges that it is an LLC, with a sole member who is a citizen of Ohio. Plaintiff also properly alleges that Defendant Tolbert is a citizen of Illinois. However, Plaintiff alleges that Defendant Resolve HR, LLC is an LLC, whose two members "reside" in Arizona. Compl. 89. "But residence may or may not demonstrate citizenship, which depends on domicilethat is to say, the state in which a person intends to live over the long run. An allegation of 'residence' is therefore deficient." Heinen v. Northrop Grumman Corp., 671 F.3d 669, 670 (7th Cir. 2012); Meyerson v. Harrah's E. Chicago Casino, 299 F.3d 616, 617 (7th Cir. 2002) ("residence and citizenship are not synonyms and it is the latter that matters for purposes of the diversity jurisdiction"). Accordingly, the Court cannot discern for purposes of 28 U.S.C. § 1332(a) whether the parties are completely diverse. The Court orders the parties to file a joint status report on or before 8/18/2026 stipulating to the citizenship of the members of Defendant Resolve so that it may assure itself of subject matter jurisdiction and move forward in this case.
