Initial Conference Hearing ~Util - Set Hearings
Minute Entry for proceedings held on 7/29/2026 before Magistrate Judge Lee G. Dunst: Civil Cause for Initial Conference. FTR #: 2:04-2:17. Case called. Counsel for all sides present. For the reasons stated on the record, the parties joint proposed schedule at DE 21 is APPROVED as follows: (1) automatic disclosures required by Federal Rule of Civil Procedure 26(a)(1) by 8/14/2026; (2) preliminary discovery necessary for reasoned consideration of settlement by 10/22/2026; and (3) fact discovery by 3/31/2027. Additionally, any motion to amend the pleadings to add claims or join additional parties must be filed by 12/4/2026. Any such motion filed on or after 12/5/2026 will be denied absent a showing of good cause under Fed. R. Civ. P. 16(b)(4). See Sacerdote v. New York University, 9 F. 4th 95, 115 (2d Cir. 2021). Counsel for Defendants Palace Electronic Contractors, Inc., George Dhaim, and Gail Dhaim shall file a notice of appearance by 8/10/2026. The parties shall submit any stipulation for an extension of time to answer the Complaint by 8/10/2026. The parties shall submit a revised Direct Assignment Acknowledgement Form by 8/10/2026. The Court will hold an in-person Settlement Conference on 11/19/2026 at 11:00AM in Courtroom 830 of the Alfonse M. D'Amato Federal Courthouse, Central Islip. All parties with settlement authority shall appear in person for the conference. The parties are directed to follow Judge Dunst's Individual Practice Rules, which are available on the Court's website. At least 7 business days prior to the settlement conference, the parties shall submit to chambers by email (dunst_chambers@nyed.uscourts.gov) ex parte settlement letters outlining the information required in Judge Dunst's Individual Practice Rule V.C.
