Motion Hearing Order on Stipulation
MINUTES OF PROCEEDINGS - Motion Hearing held on 7/30/2026 before Judge Jennifer A. Dorsey. Crtrm Administrator: S. Rivera; Pla Counsel: None Appearing; Def Counsel: Andrew Yates for Lynbrook Master Association; Court Reporter: Judy Moore; Time of Hearing: 11:16 am - 11:19 am; Courtroom: 6D;
On 7/21/26, counsel for the plaintiff and removing defendants the Internal Revenue Service and the Secretary of Veterans Affairs filed a "stipulation and order remanding case to judgment as to" these federal defendants 11 . The stipulation raised serious questions for this court, so the court set the stipulation for hearing. The only attendee at that hearing was counsel for Defendant Lynbrook Master Association, who was not even a party to this stipulation; counsel for Freedom Mortgage Corporation, Nathan F. Smith, Esq., nor counsel for the federal defendants, Tamer B. Botros, Esq. showed up. Because counsel's failure to attend this noticed hearing left this court unable to get its questions answered, IT IS ORDERED that the stipulation 11 is DENIED.
