ORDER, Because Defendant has failed to include a certificate of conference, it is unclear whether [c]ounsel cannot agree about the disposition of the motion. S.D. Tex. L.R. 7.1(D). Thus, the motion is deficient under the Southern District of Texas local rules. Accordingly, the Court ORDERS the parties to confer in good faith as required by the local rules by September 4, 2026. Defendant is further ORDERED to file a certificate of conference, describing the result of the conference no later than September 7, 2026. If Plaintiff opposes the motion, he may file a response by September 18, 2026. A motion for summary judgment is currently pending (Dkt. No. 16 ). Upon issuance of the Courts order, the court will set a status conference to determine how the parties wish to proceed. IT IS SO ORDERED.
