ORDER denying 42 Motion to Expedite; denying 42 Motion.
Although Plaintiff filed this Complaint on September 10, 2025, several Defendants have yet to be served. In this District, litigants granted in forma pauperis status under 28 U.S.C. § 1915 can request that the Court direct the United States Marshals Service to handle service of process.
In order to effectuate this service, Plaintiff must provide the Clerk's Office with a current, valid physical address for each remaining Defendant by October 23, 2026. It is the Plaintiff's responsibility to provide this information. Neither the Court nor the U.S. Marshal Service will conduct an independent investigation to locate a Defendant.
The Clerk's Office is respectfully directed to issue a summons for each remaining defendant and provide the U.S. Marshal Service with a packet for personal service. This will ensure that the remaining defendants are timely served by December 4, 2026. Accordingly, the motions to expedite enforcement of court-ordered service and for status report are DENIED.
