Magistrate Judge M. Page Kelley: ELECTRONIC ORDER entered granting 7 . Defendant ITW Food Equipment Group LLC's motion to extend the time to respond to the complaint is allowed as follows. By September 17, 2026, the Plaintiff must file either a second amended complaint with proof of written consent from ITW pursuant to Fed. R. Civ. P. 15(a)(2), or in the event that ITW opposes further amendment (its position is not explicitly stated in its motion to extend), a proposed second amended complaint and either a Rule 15(a)(2) motion for leave to amend or a motion that offers argument in support of a conclusion that amendment "as a matter of course" is available under Fed. R. Civ. P. 15(a)(1) notwithstanding that a first amended complaint was filed in the state court. ITW will have 14 days from the filing of the second amended complaint, whether by written consent or pursuant to the court's allowance of a motion, to respond to the complaint. ITW is reminded that the certified state court record is due September 14, 2026. See L.R. 81.1(a). The court further orders that the parties confer and no later than September 17, 2026, file a completed form indicating unanimous, or a lack of unanimous, consent to proceeding before the undersigned United States Magistrate Judge for all purposes, including trial and entry of final judgment, pursuant to 28 U.S.C. § 636(c). Consent to Magistrate Judge jurisdiction is entirely voluntary and no adverse substantive consequences will result from a declination of consent.
