MINUTE ORDER issued on 7/2/2026 by the Courtroom Deputy for District Judge Dena M. Coggins: On 7/1/2026, Defendants United States Postal Service and United States of America filed a 14 Motion to Dismiss, but that Motion does not comply with the meet and confer requirement in the court's [9-1] Standing Order, which states: "Prior to filing a motion in a case in which the parties are represented by counsel, counsel shall meet and confer to meaningfully discuss the substance of the contemplated motion and potential resolution. Counsel should resolve minor procedural or other non-substantive matters prior to filing the motion. The briefing on motions should be directed to substantive issues requiring resolution by the court. A notice of motion shall contain a certification by counsel filing the motion that meet and confer efforts have been exhausted, with a brief summary of the parties' meet and confer efforts." (Doc. No. 9-1 at 2.) Defendants' Notice of Motion does not include the required certification. Accordingly, the 14 Motion filed by Defendants United States Postal Service and United States of America is hereby DENIED, without prejudice to them filing a Motion to Dismiss after meaningfully meeting and conferring with Plaintiff, and any such Motion shall be filed by no later than 7/17/2026. If following those meet and confer efforts Defendants United States Postal Service and United States of America no longer wish to move to dismiss Plaintiff's claims, then they shall file their Answer to the Complaint by no later than 7/17/2026. In light of this Order, the Motion Hearing set for 8/21/2026 before District Judge Dena M. Coggins is VACATED. (Text Only Entry) (Deputy Clerk CRS)
