Order ~Util - Set/Reset Deadlines/Hearings
TEXT ORDER entered by Judge Sara Darrow on August 3, 2026. On July 17, 2026, Plaintiff filed its 27 renewed motion for default judgment. Plaintiff requests (1) an injunction "order[ing] [Defendant] to comply with its contractual obligation to timely submit all delinquent monthly contribution reports to Plaintiff in the future" and (2) a total award of $44,433.24. Renewed Mot. Default J. 4. To receive a permanent injunction, a plaintiff must demonstrate "(1) that it has suffered an irreparable injury; (2) that remedies available at law, such as monetary damages, are inadequate to compensate for that injury; (3) that, considering the balance of hardships between the plaintiff and defendant, a remedy in equity is warranted; and (4) that the public interest would not be disserved by a permanent injunction." eBay Inc. v. MercExchange, L.L.C., 547 U.S. 388, 391 (2006). Plaintiff does not demonstrate why it should receive a permanent injunction and, in fact, makes no mention of an injunction besides its inclusion as a requested relief. See generally Renewed Mot. Default J. Plaintiff is DIRECTED to file additional briefing supporting its request for a permanent injunction by August 17, 2026, and Defendant may respond by August 24, 2026. (JSH)
