Order on Motion to stay
Order. The Court has reviewed the Defendants' Motion, and all responsive briefing, along with the applicable Federal Rules and case law. The Defendants' Motion to Stay Execution on the Judgment and to Deposit Security with Court, (ECF # 273 ), is hereby GRANTED. The Court declines to include MXR lmaging's request that Defendants post an additional bond for attorneys' fees and anticipated appeal costs pending resolution of an appeal. The issues of attorneys' fees and appellate costs may be revisited upon resolution of the Defendants' appeal, if warranted. Accordingly, it is therefore: ORDERED that the Defendants' cash deposit security bond in the amount of $1,910,390.97, is APPROVED; ORDERED that any efforts to collect upon or otherwise enforce the Judgment (ECF # 255 ) against Defendants are STAYED, effective immediately, and until such time as the Defendants have exhausted their appellate remedies; ORDERED that within fourteen (14) days of the date of entry of this order, Defendants shall cause the sum of $1,910,390.97 to be tendered to the United States District Court Clerk for the Northern District of Ohio. Said funds shall be placed in interest-bearing Government Account Series securities via the Court Registry Investment System (CRIS) administered by the Administrative Office of the United States Courts; ORDERED that the Clerk accept and deposit into the registry of the Court the deposit caused to be made by the Defendants in this cause of action in the amount of $1,910,390.97; ORDERED that the Clerk promptly and properly invest those funds into Government Accounting Series securities through the Court Registry Investment System and direct the custodian to deduct the CRIS fee of an annualized 10 basis points on assets on deposit for all CRIS funds, excluding the case funds held in Disputed Ownership funds, for the management of investments in the CRIS. According to the Court's Miscellaneous Fee Schedule, the CRIS fee is assessed from interest earnings to the pool before a pro rata distribution of earnings is made to court cases; and, ORDERED that the distribution of the funds deposited with the Clerk pursuant to the terms of this order will be directed by further orders of this Court upon final resolution of the appeals taken from this Court's Judgment herein.
