2 - Set Hearings Order on Motion to Withdraw as Attorney
EO: The Court reviewed the City Defendants' 267 Motion to Withdraw as Counsel and Motion to Stay Discovery Pending Appointment of New Counsel (Motion) and 270 Plaintiff's Memorandum in Response. The Court previously denied the City Defendants' request to stay discovery and/or proceedings in this case. See ECF No. 269. As to the City Defendants' request for the withdrawal of counsel, absent any opposition and for good cause shown, this request is GRANTED. Id. at 2. However, before Page C. Ogata is terminated as counsel in this case, she must comply with the instructions below.
Page C. Ogata is DIRECTED to file a Statement no later than 7/10/2026, providing the mailing addresses for Defendants City and County of Honolulu, Jacob George Delaplane, and Vernon Branco (the City Defendants). These addresses will be added to the docket of this case, and documents in this case will be served on the City Defendants at these addresses until counsel makes an appearance on their behalf. After the docket is updated with City Defendants' addresses, Page C. Ogata will be terminated as counsel for the City Defendants. Page C. Ogata remains counsel for the City Defendants until such time.
Although Defendants Jacob George Delaplane and Vernon Branco may proceed without counsel, Defendant City and County of Honolulu may not. Defendant City and County of Honolulu must retain counsel admitted to practice in this district to proceed with this litigation. New counsel shall enter an appearance for Defendant City and County of Honolulu no later than 8/24/2026.
If new counsel does not enter an appearance by 8/24/2026, the Court ORDERS that a representative of Defendant City and County of Honolulu appear telephonically before the undersigned on 9/14/2026 at 9:30 a.m. Hawaii Standard Time, to show cause, if any, why sanctions should not be imposed for failure to be represented by counsel. The show cause hearing will be held telephonically via Zoom, using the following call-in information: Dial in number: 1-833-568-8864; Meeting ID: 161 0084 2470. Counsel for other parties may, but are not required to, attend.
