NOTICE OF VOLUNTARY DISMISSAL OF DEFENDANT TENOCO OIL COMPANY: PLEASE TAKE NOTICE, that pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), Plaintiffs, the Commonwealth of Puerto Rico and the Commonwealth of Puerto Rico through the Puerto Rico Environmental Quality Board, by and through their undersigned counsel, respectfully submit this Notice of Voluntary Dismissal of Defendant Tenoco Oil Company ("Tenoco"). Plaintiffs filed a Complaint in the United States District Court for the District of Puerto Rico, Civil Case No. 3:07-cv-01505, in June 2007 ("Puerto Rico I"), which was transferred to MDL 1358 in the United States District Court for the Southern District of New York, Civil Case No. l:07-cv-10470 (DLC). Tenoco was named as a defendant in the Third Amended Complaint in Puerto Rico I and was served with the Third Amended Complaint on April 9, 2013.Tenoco was also named as a defendant in the Complaint filed in the United States District Court of Puerto Rico, Civil Case No. 3: l 3-cv-01678, on September 4, 2013, ("Puerto Rico II") and served with that Complaint on December 30, 2013. Puerto Rico II was also transferred to MDL 1358 in the United States District Court for the Southern District of New York, Civil Case No. I: 14-cv-01014 (DLC). Tenoco has not served any answer or a motion for summary judgment in either Puerto Rico I or Puerto Rico II. No attorney has made an appearance on behalf of Tenoco or served any responsive papers in either Puerto Rico I or Puerto Rico II. Accordingly, Plaintiffs notice voluntary dismissal of Tenoco without prejudice from Puerto Rico I and Puerto Rico II. So Ordered. Tenoco Oil Company terminated. (Signed by Judge Denise L.
