Order on Motion for Reconsideration
TEXT ORDER denying 82 Motion for Reconsideration: On July 8, 2026, the Court issued an Order, granting a motion by Prudentrx LLC and Caremark Rx LLC ("Defendants") to compel arbitration of Plaintiff Sheila Gluesing's claims against them. ECF No. 81. Ms. Gluesing moved for reconsideration of the Court's Order or, in the alternative, to certify an interlocutory appeal under 28 U.S.C. §1292(b). The Court acknowledges that the parties' briefing on the initial motion to compel arbitration raised difficult issues that are not well-settled. Ultimately, the Court stands by its Order. However, the Court also recognizes that "there is substantial ground for difference of opinion," 28 U.S.C. 1292(b), as to whether the Court's Order comports with the First Circuit's recent decision in Morales-Posada v. Cultural Care, Inc., 141 F.4th 301 (1st Cir. 2025). Moreover, "an immediate appeal from the [O]rder may materially advance the ultimate termination of the litigation," 28 U.S.C. 1292(b), given that a decision as to whether Ms. Gluesing's claims belong in arbitration or in federal court will help streamline this case. Accordingly, the Court DENIES Ms. Gluesing's Motion for Reconsideration but certifies the Order for interlocutory appeal to the First Circuit. ECF No. 82. So Ordered by Chief Judge John J.
