ORDER re: 48 . By August 18, 2026, Plaintiff shall file a letter informing the Court why it seeks summary judgment against Defendant Hummingbird 761, LLC (Dkt. No. 42 ) when it entered into a confidential settlement agreement against that same party. Plaintiff also seeks to enter default and move for default judgment against all defendants. In the same letter, Plaintiff shall explain why it seeks Dkt. No. 42 in light of the anticipated default judgment motion, and whether Plaintiff would be willing to withdraw Dkt. No. 42 to file a default judgment motion against all the parties.
In Dkt. No. 22 , Plaintiff requested that Crosby Lending 2 LLC be terminated from the docket because Crosby Lending 2 LLC assigned all of its rights, title, and interest in the subject loan and mortgage to Plaintiff Allison Lending LLC prior to the filing of the Amended Complaint, and consistent with that assignment, Crosby Lending 2 LLC was omitted as a plaintiff from the Amended Complaint (Dkt. No. 11 ). Accordingly, the Clerk of Court is directed to terminate Crosby Lending 2 LLC. Ordered by Magistrate Judge Joseph A. Marutollo on 8/14/2026. (KY)
