(ZOOM) MOTION TO ENFORCE SETTLEMENT AGREEMENT; STATUS CONFERENCE RE SETTLEMENT PROCESS AS TO DEFENDANT CERVANTES by Judge John A. Kronstadt. Following a review of the submissions, the Court intends to highlight words that may raise issues, and provide those highlighted versions to the parties through the Clerk. In doing so, the Court will not be making determinations as to whether the highlighted language is inconsistent with the parties' settlement agreement, but is instead identifying issues for discussion. The parties shall then meet and confer regarding the highlighted words, seek to resolve any disputes, and be prepared to discuss any open issues with the Court. The Court sets an in-person status conference for October 1, 2026, at 1:00 p.m., with the precise time to be determined when the final calendar is issued for that date. On or before September 18, 2026, Mr. Cervantes shall provide his additional financial information and documents to Plaintiff, as well as a declaration under penalty of perjury regarding the financial information he has provided at that time and previously. The declaration shall also include a statement as to whether he is willing to be deposed regarding his financial condition. Based on a review of Mr. Cervantes information and statement, the parties shall file a joint statement by September 25, 2026, with regard to their respective and/or collective positions on a deposition of Mr. Cervantes.
