OPINION AND ORDER: the Court concludes that it is "proper" under the circumstances presented to dismiss this case. Fed. R. Civ. P. 41(a)(2). Plaintiff's counsel's unopposed motion to dismiss (ECF 25 , 26 ) and Defendants' motion to dismiss (ECF 29 ) are GRANTED, and Plaintiff's claims against Defendants are DISMISSED.
