ORDER ON STIPULATION TO ARBITRATE 10 by Judge Mark C. Scarsi: 1. Plaintiff EDGAR DARDON, and Defendant HEXPOL COMPOUNDING CA, INC. must submit this matter to binding arbitration before Deborah Crandall Saxe through the Judicial Arbitration and Mediation Service ("JAMS"). In the alternative, if Ms. Crandall Saxe is unwilling or unable to arbitrate the case, the Parties will submit the matter to arbitration before Michael Maroko through the American Arbitration Association ("AAA"). If Mr. Maroko is unwilling or unable to arbitrate the case, then the Parties will submit this matter generally to arbitration with AAA and request a strike list. Such submissions shall be pursuant to the Stipulation and Arbitration Agreement referenced therein, and be completed within 30 days after entry of this Order. The case is stayed pending the completion of arbitration. The Parties must jointly file a report regarding arbitration status every 120 days from the issuance of this Order. Each report must state on the cover pagethe date the next report is due. Additionally, the parties must notify theCourt within seven days of the conclusion of arbitration proceedings. 2. The Court shall retain jurisdiction to enforce this Stipulation to Submit Matter to Arbitration and any settlement or arbitration award as appropriate. 3. For case administration purposes only, the Court directs the Clerk to remove the case from the Court's active caseload until further application by the parties or order of this Court. (Made JS-6.
