Order on Motion to Refer/Remand to Bankruptcy Court
ORDER terminating 198 Motion to Refer/Remand to Bankruptcy Court -- On December 11, 2024, this action was stayed automatically as to Defendants Jus Broadcasting Corporation, Jus Punjabi LLC, and Jus One Corp. (collectively, "Debtors") pending proceedings before the U.S. Bankruptcy Court for the Eastern District of New York ("Bankruptcy Court") pursuant to 11 U.S.C. § 362. See, Dkt. Entry No. [182-1]; E.D.N.Y. Bankr. No. 24-45180. Thereafter, Debtors moved for an order referring the action to the Bankruptcy Court ("Motion to Refer"). See, Dkt. Entry No. 198 . Plaintiff opposes the motion. Id. For the reasons set forth below, the Motion to Refer is terminated without prejudice to its reinstatement.
Upon review of the Bankruptcy Courts docket, the Court takes notice of pending proceedings and motions that may impact this Court's ruling on the motion. For example, Plaintiff, who has filed a claim in those proceedings as a creditor (which may impact the outcome in this case), has sought an order from the Bankruptcy Court granting him relief from the automatic stay to continue this action against the non-Debtor Defendants, notwithstanding the fact that the Court has not stayed the case as to those Defendants.
