MEMORANDUM OPINION AND ORDER that the Motion to Dismiss (Dkt. 28) is GRANTED; and it is FURTHER ORDERED that the Motion to Dismiss (Dkt. 31) is GRANTED; and it is FURTHER ORDERED that the Motion to Dismiss (Dkt. 42) is GRANTED; and it is FURTHER ORDERED that the Amended Complaint (Dkt. 26) is DISMISSED without prejudice; and it is FURTHER ORDERED that Counts I and IV are dismissed without prejudice and without leave to amend; and it is FURTHER ORDERED that Counts II, III, V, and VI are dismissed without prejudice and with leave to amend to the extent that Plaintiff seeks compensatory damages; and it is FURTHER ORDERED that Count VII is dismissed without prejudice and with leave to amend to name the correct Defendant the Superintendent of Public Instruction but not as to Defendants Coons or the VDOE specifically; and it is FURTHER ORDERED that Plaintiff is DIRECTED to file any Second Amended Complaint within THIRTY (30) DAYS from the issuance of this Memorandum Opinion and Order. Plaintiff is further WARNED that, if Plaintiff fails to file a Second Amended Complaint in that timeframe, the Court will close this case for failure to follow Court Orders and failure to prosecute pursuant to Federal Rule of Civil Procedure 41.
