   MINUTE ORDER. Upon consideration of parties' 12 Stipulation of Dismissal, the Court finds that dismissal under Fed. R. Civ. P. 41(a)(1)(A)(i) is inappropriate because the defendant has filed an answer, see Dkt. 9, and Fed. R. Civ. P. 41(a)(1)(A)(i) allows for dismissal "before the opposing party serves either an answer or a motion for summary judgment." Accordingly, the Court construes the 12 Stipulation of Dismissal as seeking dismissal under Fed. R. Civ. P. 41(a)(1)(A)(ii), which permits an action to be dismissed upon filing "a stipulation of dismissal signed by all parties who have appeared." It is thus ORDERED that all claims and counterclaims asserted are dismissed with prejudice, and each party shall bear its own attorneys fees and costs.
