ORDER OF DISMISSAL granting 73 MOTION to Dismiss: This action is dismissed without prejudice pursuant to Federal Rule of Civil Procedure 41(a)(2). It is further ORDERED that the United States shall deliver the U.S. Currency named as the defendant property in this case and the U.S. Currency seized as evidence in the related criminal case No. 3:14-CR-293 (N.D. ORDER: The United States is ORDERED to file a motion to dismiss or a status report in case number 3:12-CV-893-M-BK on or before 8/30/2018. In the event that case number 3:12-CV-893-M-BK is dismissed and/or the United States ceases its pursuit of judicial or administrative forfeiture of property seized in connection with the criminal charges in case number 3:14-CR-293-M, the United States is ORDERED to deposit into the registry of the Court the U.S. currency that is the subject of the civil forfeiture action in case number 3:12-CV-893-M-BK and the U.S. currency seized as evidence in connection with the dismissed criminal charges in case number 3:14-CR-293-M. Price is ORDERED to pay the additional sum of $38,662.99 (reflecting the balance of the CJA funds expended for Price's defense after the application of the total previous recoupment of $99,864.58 and the aforementioned seized sums) on or before 3/31/2019. Based on the Court's review of the financial circumstances of each, the Court finds that Price and Fain are financially able to obtain or pay counsel in relation to any further proceedings in case number 3:14-CR-293-M. Accordingly, the appointments of counsel for Price and Fain are TERMINATED. (Ordered by Magistrate Judge Renee Harris Toliver on 8/23/2018) (epm)
