Electronic Clerk's Notes for remote Status Conference held on 10/1/2026 before District Judge Julia E. Kobick:
Case called. The Court notes it received a motion from the plaintiff at 33 earlier this week and the parties inform the Court they were only able to confer in part on the motion. The Court hears from the defendant on their position on the pending motion. Counsel will be filing an opposition on the docket within the fourteen days pursuant to the Local Rules. The parties inform the Court they have been actively conferring about resolving the case. The plaintiff provides information to the Court regarding the delay in taking depositions and the remainder of discovery. The defendant further indicates, if the Court grants any extension of discovery, they would be requesting an extension for limited scope to only the depositions that were noticed. The Court asks the parties their positions as to mediation; plaintiff is interested but the defendant does not think a referral is appropriate at this time. The Court asks the defendant to include its position on mediation when it files their opposition to the pending motion. The parties confirm they will not be conducting expert discovery. The Court will await the defendants' opposition on the pending motion and will make a ruling on the papers.
