Order on Motion for Pre Motion Conference Scheduling Order
SCHEDULING ORDER: Defendants' 11 and 15 motions for pre-motion conference ("PMC") are denied as unnecessary. Defendants are reminded that, pursuant to the Court's Individual Practice Rule 5.1.1, pre-motion conferences are not required for cases in which one or more parties are proceeding pro se. Defendants are further advised that PMC letters are construed as timely motions under Fed. R. Civ. P. 12. See Individual Practice Rule 5.1.2.1. Pursuant to Individual Practice Rule 5.2.3, Defendants State of New York Corp. and Olga Kazoleas-Awan shall serve their dispositive motions to dismiss on or before September 4, 2026. Plaintiff shall serve his opposition on Defendants on or before September 25, 2026, and Defendants shall serve their replies, if any, on or before October 9, 2026. Defendants shall file their fully briefed motions to the docket on or before October 9, 2026. Discovery shall be stayed while both the Court's Order to Show Cause and the motions to dismiss are pending. The Clerk of Court is respectfully directed to mail a copy of this Order to pro se Plaintiff and to note the mailing on the docket. Ordered by Judge Nina R. Morrison on 8/14/2026. (OA)
Order to Show Cause
ORDER TO SHOW CAUSE: Plaintiff is directed to show cause on or before August 28, 2026 as to why this case should not be dismissed against Defendant Rosmil Almonte, a Family Court Support Magistrate, on judicial immunity grounds. See Grijalva v. Coward, No. 24-CV-6365 (NJC) (ST), 2024 WL 5057652, at *4 (E.D.N.Y. Dec. 9, 2024) (noting that the "absolute judicial immunity afforded to judicial officers for conduct undertaken in their judicial capacity and within the jurisdiction of the court" applies to New York Family Court Support Magistrates (citing Arce v. Turnbull, No. 21-CV-642, 2021 WL 5816687, at *1 (2d Cir. Dec. 8, 2021) (summary order))). Defendant Almonte shall file a response within seven (7) days of Plaintiff's submission, but no later than September 4, 2026. The Clerk of Court is respectfully directed to mail a copy of this Order to Plaintiff and to note the mailing on the docket. Ordered by Judge Nina R. Morrison on 8/14/2026. (OA)
