MINUTE entry before the Honorable Mary M. Rowland: The Court has reviewed the Second Wave Defendants' status report 1983 regarding the continuance of the stay of discovery. Counsel for Second Wave Defendants' have conferred and believe that continuing to stay discovery as to these Second Wave Defendants would be the best use of the Court's and the parties' resources while the parties continue to engage in discussions subject to FRE 408. Counsel for PSC is "not inclined to agree to continue the stay." The Court always encourages FRE 408 discussions. But this matter has been stayed since December 2025. 1583 . Can the parties report that real progress has been made? It is time to litigate. The stay on discovery as to Second Wave Defendants is lifted. The next status is set for 8/20/26. In the Joint Status Report the parties should propose deadlines for the Second Wave Defendant discovery. That discovery will be supervised by Judge Jantz. The Court has also reviewed the Ashcraft & Gerel Plaintiffs' status report 1982 , where attorney McCulley reports his compliance with the Court's prior order 1955 directing Attorney McCulley to file appearances on individual member dockets.
