Order on Motion to Stay
ORDTEXT ORDER entered by Magistrate Judge Eric I. Long on 11/13/2024. Moarbes, LLP filed a Motion for Stay of Judgment 143 . Defendant's deadline to file a response in opposition was 10/11/24, but Defendant has not filed a response. Pursuant to Local Rule 7.1(B), the Court presumes Defendant does not oppose Moarbes's Motion and will rule without further notice. Federal Rule of Procedure 62(b) provides, "At any time after judgment is entered, a party may obtain a stay by providing a bond or other security." Fed R. Civ. P. 62(b). Moarbes attaches documentation showing it applied for a bond with Colonial Surety Company and received that bond on 9/27/24 in the amount of $23,219.30, the full amount that the Court ordered Moarbes to pay. See 138 . Accordingly, Moarbes' Motion for Stay of Judgment 143 is GRANTED. The Appeal Bond issued by Colonial Surety Company [143-3] is hereby approved. A signed copy of the Bond will be entered into the record of this matter. The 3/27/24 Judgment of this Court against Moarbes, LLP is hereby stayed until Moarbes has fully prosecuted its appeal of this Judgment. (BMG)
Remark
