Order [non-document]: In their joint status report filed on September 11, 2026, the parties represented that they "anticipate[d] submitting the [Deed-in-Lieu Agreement] and proposed consent order no later than Monday, September 21, 2026." The Court has not received those documents. Indeed, the attorneys have represented to the Court on multiple occasions that the settlement would be finalized, but their representations to the Court have not materialized. The Court will no longer accept the assurances of counsel, particularly as the Receiver seems to raise issues that should have been discovered and resolved months ago and, thereby, has continuously delayed the settlement. To avoid further delays in finalizing the settlement in this case, an in-person hearing, with lead counsel and party representatives (with settlement authority), on the pending motion filed by The Evergreen Advantage, LLC (Doc. No. 156 ), is scheduled for October 7, 2026, at 1:30 p.m. Any supplemental briefing should be filed by September 30, 2026.
