   Motion Hearing Order on Motion for Approval of Infant Compromise Order on Motion for Default Judgment

   Minute Entry and Order for Hearing on Motion for Approval of Infant Compromise held on 7/22/2026 before Judge Brian M. Cogan. Counsel for both sides appeared. Plaintiffs' former attorney, Jon Norinsberg, appeared, along with his counsel, Joseph Pace, who appeared telephonically. Upon review of the proposed settlement materials, I find that the settlement is fair and reasonable and in the infant plaintiffs' best interests. See Martegani v. Cirrus Design Corp., 687 F. Supp. 2d 373, 377 (S.D.N.Y. 2010). This case has already been pending for over six years; taking it to trial would have protracted it further and compounded the expense involved. In addition, the settlement is not only substantial in its own right, but in light of the fact that due to the inherent complexities of this case, defendants might have prevailed or partially prevailed at trial. I also find that the requested attorneys' fees, one-third of the total settlement, are reasonable in light of counsel's work expended in this matter, including investigating plaintiffs' claims and the mountain of documents concerning them, and negotiating the settlement (and navigating the many difficulties that arose during that process). Accordingly, the settlement is approved. The parties shall file a revised proposed order which omits current paragraph 4 and explains that the $3 million apportioned for attorneys' fees will be held in escrow pending resolution of Mr. Norinsberg's claim. Plaintiff's current and former attorneys shall propose a briefing schedule for the motion to enforce that charging lien. See transcript for details. (Court reporter: Charline Ross.) (PW)
