   TEXT ORDER: The settlement conference held on 9/9/2026, (see Dkt. No. 406 ), did not resolve this matter. The undersigned intends to continue ex parte settlement discussions with the parties following disposition of Defendant's pending Motion to Amend. (See Dkt. No. 321 ). Considering this Court's precedents regarding Rule 15 futility analyses, see, e.g.,, Ricketts v. City of Paterson, No. 25-1601, 2026 WL 2286458, at *2 (D.N.J. Aug. 6, 2026) ("[I]t is well-settled law that futility arguments are dispositive arguments that are better suited for consideration in a motion to dismiss."); Colombo v. Bd. of Educ. for the Clifton Sch. Dist., No. 11-785, 2016 WL 6403081, at *2 (D.N.J. Oct. 27, 2016) ("In the interests of judicial economy and in the absence of undue prejudice, the Court may decline to engage in a detailed futility analysis where the Court finds that these arguments are better suited for consideration in the context of a motion to dismiss."), no later 9/23/2026, Plaintiff shall advise the Court in writing whether Plaintiff consents to the filing of Defendant's proposed Amended Answer, Counterclaims, and Third-Party Complaint. (See Dkt. No. [322-1]). The parties shall file their joint dispute letter regarding subject-matter waiver no later than 9/14/2026. The Court will hold an in-person status conference in Courtroom 9 of the Frank R.
