Notice to Counsel of Local Rule
NOTICE of Local Rule 1.11(e), which provides that, unless an order states another time, a seal under Rule 1.11 expires ninety days after a case is closed and all appeals are exhausted. To prevent the content of a sealed item from appearing on the docket after the seal expires, a party or interested non-party must move for relief before the seal expires. (Signed by Deputy Clerk). Order Dismissing Case
ENDORSED ORDER of DISMISSAL. On November 13, 2017, the Court entered an Order staying this case pending the Eleventh Circuit's decision in Orion Marine Construction, Inc. v. Mark Dawson, et al, Docket No. 17-11961. (Dkt. 365) On June 19, 2019, the Court entered an Order directing the Parties to file a Joint Notice advising the Court as to whether and to what extent this matter should proceed in light of the reopening of In re: Orion Marine Construction, Inc., Case No. 8:15-cv-1136-MSS-TGW. (the "Limitations Action") (Dkt. 366) This case has not advanced since the Parties filed the requested joint notice on July 10, 2019. (Dkt. 367) However, in the Limitations Action, the Parties agreed to permit, and the Court permitted, Orion to amend its affirmative defenses in that action to include the defenses that are the gravamen of this case. (See Dkts. 700, 709, 711, 712) Orion further agreed that this action would remain stayed or could be dismissed without prejudice while the Parties proceeded in the Limitations Action. The Limitations Action finally concluded in June 2023, but this action remained in a stayed posture. It is now moot. Accordingly, this case is DISMISSED. The CLERK is directed to CLOSE this case.
