Minute Order Order on Motion to Compel
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Nancy J. Koppe on 9/9/2026. Pending before the Court is a motion to compel a continued Rule 30(b)(6) deposition. Docket No. 34 . Although the motion recognizes that the discovery cutoff has expired, it fails to discuss the well-established law that a motion to compel filed after the dispositive motion deadline is presumptively untimely and will be considered only in unusual circumstances. E.g., Garcia v. Serv. Emps. Intl Union, 332 F.R.D. 351, 354 (D. Nev. 2019) (collecting cases). In addition, the filing violates the local rules by combining the motion and exhibits thereto into a single PDF. But see Local Rule IC 2-2(a)(3)(A). Accordingly, the motion to compel is DENIED without prejudice. Any renewed motion to compel must be filed by September 14, 2026. IT IS SO ORDERED.
