ORDER: The parties' Joint Motion for Entry of Stipulated Protective Order (R. 293 ) is hereby GRANTED, and the proposed Protective Order (R. 293 -1) is hereby ACCEPTED AND INCORPORATED BY REFERENCE, subject to the following revisions: 1) Any reference within the Protective Order to "Confidential Information" or "Protected Health Information" will be treated as the same, and shall be referenced in future filings, if at all, as "Confidential Information." 2) Paragraphs 5(a), 22, and 40 are hereby STRICKEN from the Protective Order. 3) Paragraph 6 is hereby MODIFIED to exclude reference to any third-party. The parties may designate materials as "Confidential Information" pursuant to the Protective Order, but third-parties may not. 4) Paragraphs 9 and 12 are subject to the Court's discovery dispute procedure provided in the Standing Case Management and Referral Order (R. 11 at Page ID 499, paragraph 5). 5) Paragraph 20 is hereby MODIFIED to read as follows: Any documents marked "Confidential Information" can be filed under provisional seal pursuant to this Protective Order and Joint General Order 21-1. However, in order to continue the sealed nature of the filing, the party designating the document as "Confidential Information" must move the Court within seven (7) days thereafter to maintain the document under seal, stating why sealing is required. The "Confidential Information" designation provided by this Protective Order is pursuant to the agreement of the parties and pertains to discovery specifically. The parties' designations are preliminary and are not a judicial determination that any particular item is, in fact, protected from disclosure unless and until so determined by the Court. 6) Paragraph 33 is hereby MODIFIED to read as follows: Breach of this Order may be punished by the contempt powers of this Court.
