Status Conference ~Util - Speedy Trial - Excludable Start ~Util - Set/Reset Hearings
Minute entry for proceedings held before Hon. Colleen D. Holland. Status conference held as to Deche Davis on 6/30/2026. Appearances: Brandon N. Gonzalez, AUSA; Jeffrey L. Ciccone, AFPD, with Defendant. Defendant and the government continue to discuss a potential global resolution of this matter and the related state court charges. Defendant advises that he requires additional information regarding the evidence in this matter and has been working with the government to resolve the issue. Defendant requests additional time to inspect the evidence as discussed on the record, and to have further discussions with his counsel as to the impact the evidence may have on the proposed resolution of this matter and the related state court matter. A status conference is scheduled for 8/13/2026 at 9:30 a.m., in Courtroom 4, 1st Floor, 100 State Street, Rochester NY before Hon. Colleen D. Holland. Defendant asks for an interests of justice exclusion from the speedy trial clock until next appearance; government joins in request. The Court excludes time between 6/30/2026 and 8/13/2026 as to Deche Davis. (Court Reporter FTR Gold.)(DAF)
Order on Motion to Adjourn
TEXT ORDER granting 21 Motion to Adjourn Status Conference as to Elias Circle (1). The Status Conference shall be adjourned until 7/23/2026 at 9:30 AM before Hon. Mark W. Pedersen. At Defendant's request, time is excluded in the interests of justice pursuant to 18 U.S.C. § 3161(h)(7)(A) until the adjourn date. I find that the Defendant's and the public's interest in a speedy trial are outweighed by the Defendant's interest in having sufficient time to continue plea negotiations with the Government. Should the parties need additional time to continue resolution discussions, a request must be filed, in writing, no less than 2 business days in advance of the new scheduled date. SO ORDERED. Signed by Hon. Mark W. Pedersen on 6/5/2026.(JB)
