Order on Motion to Adjourn
TEXT ORDER granting in part and denying in part 25 Motion to Adjourn Status Conference as to Elias Circle (1). The Court GRANTS Defendant's motion to adjourn proceedings and exclude time, but DENIES the 60-day length of time being requested and will instead re-calendar the matter for status in approximately 30 days.
The Court notes the most recent order granting an adjournment of these proceedings reads, "the Court is disinclined to grant an additional adjournment and exclusion of time beyond 9/10/2026 absent either the parties appearing in person before the undersigned on 9/10/2026 at 9:30 AM or the parties scheduling a Plea Hearing before a District Judge in advance of 9/10/2026." As of this date, the Court is not aware of the parties contacting a District Judge for purposes of scheduling a Plea Agreement Hearing. Further, Defendant's last personal appearance in this Court was on 9/22/2025, and the Court is becoming concerned with delays in this case. Be that as it may, the parties have appeared for proceedings on other dates in this case, albeit with Defendant's presence being waived. Additionally, the Court has received no reports of Defendant violating his conditions of supervised release (ECF No. 9 ).
Accordingly, the Status Conference shall be adjourned until 10/13/2026 at 10:30 AM before Hon. Mark W. Pedersen. At Defendant's request, time is excluded in the interests of justice pursuant to 18 U.S.C. § 3161(h)(7)(A) until the adjourn date. I find that the Defendant's and the public's interest in a speedy trial are outweighed by the Defendant's interest in having sufficient time to continue plea negotiations with the Government. Defendant is ordered to appear in-person for the next Status Conference for purposes of addressing his right to a Speedy Trial pursuant to the Sixth Amendment to the United States Constitution.
