MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER TO SHOW CAUSE RE SUBJECT MATTER JURISDICTION. The Court orders Defendant to show cause why this action should not be remanded to the San Bernardino County Superior Court for lack of subject matter jurisdiction. Defendant shall file a written response within seven days either acknowledging the Court lacks diversity jurisdiction or establishing by a preponderance of the evidence that the amount in controversy "more likely than not" exceeds $75,000. Plaintiff may file a written response within seven days of the filing of Defendant's response. Alternatively, this order to show cause may be satisfied by a statement or stipulation acknowledging that the Court lacks jurisdiction and consenting to remand. (lc)
