[Doc. 62 ]. Although the title of the filing references a motion for summary judgment, the Court observes that the document itself does not actually seek summary judgment pursuant to Rule 56. To the extent Plaintiff does attempt to seek summary judgment in this response brief, any request is procedurally improper under the Local Rules and the Federal Rules of Civil Procedure. See, e.g., D.C.COLO.LCivR 7.1(d) ("A motion shall not be included in a response or reply to the original motion. A motion shall be filed as a separate document."); Fed. R. Civ.
