Order on Motion to Appoint Pro Bono Counsel Order on Motion for Extension of Time to Answer or Otherwise Respond
ORDER by Magistrate Judge Susan Prose on June 30, 2026. Before the court are Claimant Joshua Campbell's 27 Motion for Appointment of Counsel and 28 Motion for Extension. Upon review of the 27 Motion and the docket in this case, this court cannot conclude that appointment of counsel is warranted at this time. The court does not find that the legal issues presented in Plaintiff's claims are so uniquely complex as to justify appointed counsel. "[T]he right to counsel in a civil case is not a matter of constitutional right under the Sixth Amendment." MacCuish v. United States, 844 F.2d 733, 735 (10th Cir. 1988). Further, it is too early for this court to assess the merit of Plaintiff's claims, which is one of the factors that the court is to consider under the local rule establishing the pro bono program, D.C.COLO.LAttyR 15. Thus, Mr. Campbell's 27 Motion to Appoint Counsel is DENIED without prejudice to refiling after Plaintiff's case moves forward. Mr. Campbell is directed to the court's Order at ECF No. 36 , which notes two resources available to pro se parties. Regarding Mr. Campbell's 28 Motion for Extension of Time, the Motion is GRANTED. Mr. Campbell's answer is now due August 5, 2026. Objections to this order are due within fourteen days. Fed. R. Civ. P. 72(a).
