ORDER: The Court GRANTS the 24 Joint Motion to Waive Mediation Requirement in part. The Court will accept the parties' representation that mediation would not be productive at this time but will require that the parties participate in mediation prior to any trial in this case. Rather than waive the requirement for mediation altogether, however, the Court STAYS the mediation deadline and VACATES the trial date imposed in the Initial Scheduling Order.
